A Recent Supreme Court Decision Recognizes Harm to Children After Separation and May Allow Additional Remedies

Parental alienation, family violence, and money in divorce.  Those are three of the most controversial topics in Family Law.  This episode of the Family Law Podcast addresses an Issue that covers all of them: “Can an alienated parent seek financial compensation from the alienating parent for the loss of the relationship with a child?”

In ⁠Ahluwalia v. Ahluwalia⁠, the Supreme Court of Canada gave direction and created new options for family court judges dealing with intimate partner violence.  That is an ongoing important issue in Family Law. It is one which t⁠he 2021 Amendments to the Divorce Act ⁠and other family law made even more important. 

Many professionals who have studied parental alienation, or who offer treatment programs for it, say that parental alienation is a form a family violence and child abuse.  And they say it is not just a mild form of violence. They say it is the worst form: coercive controlling violence.

In Ahluwalia v Ahluwalia, the Supreme Court gave direction to Canadian Courts about how to address coercive controlling violence.  It included actions related to parental alienation in the decision.   The Court also went on to say when financial remedies may be appropriate.  In this episode of the Ontario Family Law Podcast, ⁠Certified Specialist ⁠in Family Law, ⁠John Schuman⁠, explains why money may be available for alienated parents.
